Inner Pose Wellness (also referred to in these Terms of Use as ‘us’, ‘I’, 'we' or the ‘Yoga Teacher’) is a service provider of yoga classes to groups of people, corporate entities and private individuals both online and in-person (the 'Class(es)'). The Classes together with such other programmes or services as we shall provide shall be known as the Service(s). The following Terms of Use set out a clear understanding of how you shall use this website, www.innerposewellness.com (the Website), the associated Services offered, its contents and functionality.
By using the Website and/or the Services, including clicking on the links to book any Classes or purchase any product, you acknowledge your acceptance of and agreement to these Terms of Use. Inner Pose Wellness reserves the right to modify, alter, amend or update the Website, policies, and these Terms of Use. These Terms of Use are subject to change without notice. If you do not agree with or do not accept any part of these Terms of Use, you must not use the Website, the Services or otherwise purchase from Inner Pose Wellness.
Disclaimer
We want you to enjoy the Services provided by Inner Pose Wellness. For our online Classes, because we can’t be there with you and it is impossible for the yoga teacher to see everyone in the class all of the time, it’s important that you take responsibility for your own practice by acknowledging and respecting your own physical limitations. You understand that yoga, like any exercise programme isn’t a substitute for a medical diagnosis and/or treatment and can involve strenuous physical activity and that such activity may carry a risk of injury. It is your responsibility to assess your capabilities for such activities and that you will not exceed your limits while performing such activity. Inner Pose Wellness cannot accept any responsibility for anything that you choose to do with your body in the comfort of your own home. You understand that it is your responsibility when participating in a Class to find a pace that suits you. We assume no responsibility for injuries incurred while practicing yoga with us. You acknowledge and agree that you participate in the Services at your own election and at your own risk. You hereby expressly waive and release any claim that you may have at any time for injury of any kind against Inner Pose Wellness, or any person or entity operating on our behalf.
When you are starting any exercise programme or making a lifestyle change or participating in the Services, you are aware of the physical risks involved and you understand that it is your personal responsibility to consult with your doctor or other health care provider regarding such changes and/or your participation before you begin Classes with us. If you have any concerns about your physical health, you should seek advice from your doctor or health care provider. This is particularly important if, for example only and not by way of limitation, you are overweight, pregnant, nursing, regularly taking medication, are over 65, or have any existing medical conditions.
During your participation in a Class, it’s important that you do not do any pose and/or activity to the extent that you are straining or forcing it or you are in pain, feeling dizzy, faint, light-headed, or where you experience any discomfort. If you do, stop the activity immediately and/or come out of the pose and inform the Yoga Teacher. If in doubt or you are unclear about an instruction, activity or pose given, please discuss it with the Yoga Teacher before you attempt it.
Inner Pose Wellness is not a medical organisation and its yoga teachers cannot provide medical advice or diagnosis. The techniques and suggestions presented on this Website and in our Classes are not intended to be a substitute for proper medical advice.
We reserve the right to refuse a Service and/or anyone’s participation in a Class where it is deemed that the practice may be unsafe or unsuitable. This could be for reasons including but not limited to addiction, severe depression, severe anorexia, a serious mental health condition, or similar medical/clinical, physical, or mental condition (“Contraindication”). If you choose not to declare to us a Contraindication, this may result in you being refused admission to or excluded from a Class. Under such circumstances, we reserve the right to refuse a refund.
Physical or verbal aggression towards our yoga teacher(s) will not be tolerated and Inner Pose Wellness reserves the right to exclude disruptive or aggressive participants from a Class or to refuse provision of our Services. Under such circumstances no refund of any payment made shall be granted.
You understand that we are not responsible for your results as a result of your participation in the Services and that results may vary from person to person. There is no guarantee that you will see positive results to your health by participating in the Services. We assume no responsibility for your health, your decisions, or for any policies or practices that you implement. We make no representations, warranties, or guarantees regarding results, present, future, or otherwise. Any statements made related to health and/or potential outcome as part of our Services are examples of what may be possible in the future.
You declare that you have read this release and waiver of liability and understand its contents. You agree to the terms and conditions stated herein.
Inner Pose Wellness has made every effort to ensure the information about the Services as stated on this Website have been checked for accuracy. We assume no responsibility for errors or omissions that may appear in such information and/or the Services.
Class Attendance & Cancellation Policy
If you register for a class or Block Booking this means you are scheduled to attend a class on each consecutive date in your schedule which is indicated on the Website at the time of your booking and in our confirmation email. In the event you are unable to attend a class, you will email us to let us know no less than 48 hours before the start of the scheduled class and we will be happy to give you a credit (“credit”) for that class. A credit will allow you to attend without additional charge the next available class within a 45-day window of the date of the first cancellation (“Credit Window”). In the event you are unable to use the credit within the Credit Window, we are unable to further extend the credit beyond the Credit Window, and you will forfeit the credit. Refunds are not available. For the avoidance of doubt, credit is non-transferable to another person. Inner Pose Wellness is unable to offer a credit more than twice whether during a Block Booking or otherwise. An offer of a Credit shall be at the sole discretion of Inner Pose Wellness whose decision shall be final.
In the event that: (i) you do not attend a class you have booked (a “No Show”), or (ii) you are 15 mins or more late for a class (“Late Arrival”), or (iii) you cancel your attendance to a class less than 48 hours before the start of the scheduled class, (“Late Cancellation”), these together shall be deemed a “Short Notice Cancellation”. While we accept that absences and cancellations are sometimes unavoidable you understand that you will not receive a Credit or a refund for a Short Notice Cancellation and you will forfeit the full fee.
In very exceptional circumstances Inner Pose Wellness may need to cancel a class at short notice. In the rare event that we need to cancel a class, Inner Pose Wellness shall elect to offer you an alternative comparable service such as an online offering or a credit to attend a class without additional charge within a Credit Window. Ideally, sign up to our mailing list via the Website so you can be kept informed of any schedule changes. You have the option to unsubscribe from the mailing list at any time.
